Terms of Service

Last updated: October 20, 2026

Welcome to xpaint. These Terms are an agreement between you and the operator of xpaint (“we” or “us”) governing your use of xpaint.com and related services (the “Service”). Please read them carefully. By creating an account or continuing to use the Service, you agree to these Terms and to our Privacy Policy.

Read the Privacy Policy

1. Accepting these Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you don't agree with any part of them, please don't use the Service.

These Terms and our Privacy Policy together make up the agreement between you and us about the Service. Where a feature of the Service has its own specific rules, those rules also apply.

2. Eligibility

You must be at least 13 years old to create an account. If you are under the age of majority where you live, please use the Service only after a parent or legal guardian has read and agreed to these Terms.

If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.

3. Your account

You can sign up with an email address or a phone number. You agree to:

  • provide true and accurate information when you sign up, and keep it up to date;
  • keep your password safe, not share your account with others, and take responsibility for activity under your account;
  • change your password and let us know right away if your account is compromised or has any other security problem;
  • not use a username, display name, or handle that impersonates someone else, impersonates xpaint, or is otherwise misleading.

Some features are available only after you verify your email address or phone number.

4. The paintings collection

The world-famous paintings on the Service come from museums' open access programs, currently mainly The Metropolitan Museum of Art. These works are in the public domain, and their images and data are provided under the terms each museum has published (such as CC0). Every painting's page names the museum it belongs to.

Translated titles, descriptions, commentary, and similar material about the paintings are written by us for enjoyment and reference only and may contain mistakes. If you spot an error, please let us know.

5. Works you publish

You keep all rights to the works and related content you publish on the Service (images, titles, descriptions, creation details, collections, and so on — “your content”). We don't gain ownership of your content by your publishing it.

To run the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, copy, convert the format and size of (for example, to create thumbnails), display, and distribute your content, to the extent needed to provide, display, and promote the Service. For content you set to private, we use it only as needed to provide the Service to you.

When you delete a work, it first goes to your trash and is permanently deleted after 30 days; you can also empty the trash sooner. Once a work is permanently deleted, the license above ends for that work, but this doesn't affect copies others have lawfully obtained under the license you chose.

You represent that you have the right to publish your content and grant the license above, and that your content doesn't infringe anyone's copyright, trademark, right of publicity, privacy, or other rights. If a work uses someone else's work, materials, or models, you're responsible for making sure that use is licensed or otherwise permitted by law.

6. Licensing options and AI use

When you publish a work, you can choose the license it's offered to other users under: CC0, CC BY 4.0, CC BY-NC 4.0, CC BY-SA 4.0, or All Rights Reserved (the default). You can also separately choose whether others may use the work for AI derivative works or training, and whether to offer the original image for download.

We show your choices accurately on the work's page. Other users must follow the license you chose when they use your work. We can't guarantee that everyone will, but when we receive a valid complaint, we'll handle infringing content on the Service as described in these Terms.

Some licenses can't be withdrawn once granted (Creative Commons licenses, for example, are irrevocable) and remain in effect for anyone who has already obtained the work under them. Please choose carefully before publishing.

7. Labeling how a work was made

xpaint asks that every work clearly states how it was made — for example, fully AI-generated, or created by AI and a person together. You agree to label your works truthfully, not to present AI-generated works as made by hand, and not to enter false creation details.

The creation details you enter (such as the models, tools, prompts, and parameters you used) are shown together with the work, to whoever can see the work under the visibility you set. Please don't include anything you don't want to make public.

8. Prohibited conduct

When using the Service, you must not:

  • post content that infringes others' copyrights, trademarks, rights of publicity, privacy, or other rights;
  • post unlawful content, or content that promotes violence, hatred, or discrimination, or that harasses others;
  • post any sexual or sexualized content involving minors;
  • publish other people's personal information without their consent, or use a real person's likeness to create misleading, demeaning, or sexual content;
  • impersonate any person or xpaint, or otherwise mislead others;
  • post spam or advertising, create accounts in bulk, or manipulate likes, follows, view counts, or other metrics;
  • scrape content or data from the Service at scale by automated means without permission, or bypass or break the Service's security and access controls;
  • interfere with or disrupt the Service, its servers, or networks, or try to gain unauthorized access to other people's accounts or data.

9. Moderation and enforcement

We may review and rate content. Some content may be shown only to signed-in users, or not shown in certain countries or regions because of local laws and cultural differences.

If we believe content or conduct violates these Terms or the law, or may harm others, the Service, or us, we may limit its visibility, take it down, or delete it, and, depending on the severity, suspend or terminate the accounts involved. In urgent cases we may do so without prior notice.

We have no obligation to review all content in advance. The person who posts content is responsible for it.

10. Reporting infringement

If you believe content on the Service infringes your copyright or other rights, please notify us using the details in the “Contact us” section, and include as much of the following as you can:

  • who you are and how to reach you;
  • a description of the right you hold, with supporting evidence;
  • a link to the page where the allegedly infringing content appears;
  • a statement that you believe in good faith the use is not authorized, and that the information you've provided is true and accurate.

We'll act promptly on valid notices and notify the person who posted the content where appropriate. If they believe the content was removed by mistake, they can ask us to reconsider. We suspend or terminate accounts of repeat infringers.

11. Our rights

Apart from your content and the public-domain paintings themselves, the Service's design, interface, code, the xpaint name and logo, and the translations, descriptions, and commentary we write belong to us or the relevant rights holders. Please don't copy, modify, or use them commercially without permission.

You're welcome to browse the Service and link to its pages for personal enjoyment, learning, and sharing.

12. Changes to and interruptions of the Service

We're always improving the Service and may add, change, or discontinue features. We do our best to keep it running smoothly, but we don't promise it will always be uninterrupted, timely, or error-free; maintenance, upgrades, network failures, or events beyond our control may make it temporarily unavailable.

Please keep your own backups of works and information that matter to you.

13. Disclaimers and limitation of liability

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages (including loss of data or profits) arising from your use of, or inability to use, the Service. Where the law requires otherwise, the law prevails.

14. Termination

You can stop using the Service at any time. If you'd like your account deleted, please contact us.

If you violate these Terms, we may suspend or terminate your account. Provisions of these Terms that by their nature should survive termination (such as your representations, the disclaimers, and the limitation of liability) will continue to apply.

15. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version on this page and change the “Last updated” date at the top; for significant changes, we'll let you know by a notice on the site, by email, or by other reasonable means. If you keep using the Service after the changes take effect, you accept the updated Terms.

16. Contact us

If you have any questions about these Terms, or need to reach us about an infringement claim, your account, or anything else, please get in touch.
